Terms and Conditions of Sale

This is a translation for convenience. The Portuguese version is the binding text and prevails in case of any difference.

These Terms and Conditions govern purchases made in the Quinta online shop at https://farm.pedrorualves.eu. By placing an order, the customer confirms that they have read and accept them. The version that applies is the one published when the order is placed, and it is recorded on the order.

1. Who we are

  • Seller: [Denominação social]
  • Tax number (NIPC): [NIPC]
  • Registered office: [Morada da sede]
  • Contact: geral@exemplo.pt
  • Food business operator registration (DGAV): [N.º registo DGAV]

2. Scope

  1. The shop serves consumers and businesses and sells food products from our own farm: olive oil, honey, nuts and gift boxes.
  2. Anyone may browse and buy. We deliver only to addresses in mainland Portugal. Visitors from other EU Member States are never blocked or redirected (Regulation (EU) 2018/302).

3. Products and information

  1. Each product page shows the mandatory food information: name, ingredients, highlighted allergens, net quantity, storage conditions, country of origin and the operator's details (Regulation (EU) No 1169/2011). The best-before date is printed on the packaging.
  2. Photos are for illustration. As these are agricultural products, colour, aroma and texture may vary from harvest to harvest, and this is not a lack of conformity.
  3. Products are subject to availability. If an ordered product becomes unavailable, we will tell you straight away and refund the amount paid within 14 days at the latest.

4. Prices

  1. All prices are in euros and include VAT at the applicable rate (Decree-Law 138/90). The price per litre or per kilogram is shown next to the selling price (Decree-Law 162/99).
  2. Shipping costs are shown before the order is confirmed and added to the total. Shipping is free for orders from 60 €.
  3. We charge no extra fee for any payment method (Decree-Law 91/2018).
  4. When we announce a price reduction, the previous price shown is the lowest price applied in the 30 days before the reduction (Decree-Law 70/2007 as amended by Decree-Law 109-G/2021).
  5. In case of an obvious pricing error (for example, a clear typing mistake), we will contact the customer before shipping. The customer can then keep the order at the correct price or cancel it for a full refund.

5. Placing an order and forming the contract

  1. To order, the customer adds products to the cart, enters the delivery address and billing details, chooses a shipping method and a payment method, reviews the summary and accepts these Terms and Conditions.
  2. Before confirming, the customer can check and correct all details. The order is only submitted by pressing the "Order with obligation to pay" button (art. 5(3) of Decree-Law 24/2014).
  3. The contract is formed when we send the order confirmation email. It includes the order summary, these Terms and Conditions and the information on the right of withdrawal, and is the confirmation on a durable medium.
  4. We keep a copy of every order, which the customer can view in their account or request by email.

6. Payment

  1. We accept MB WAY, Multibanco reference, credit or debit card, Apple Pay and Google Pay, processed by ifthenpay, an institution authorised by Banco de Portugal. [VERIFY: contracted payment provider]
  2. We neither see nor store card details.
  3. Multibanco reference: payment must be made within the period shown with the reference. If it is not paid in time, the order is cancelled automatically at no cost.
  4. MB WAY: the payment request must be approved in the MB WAY app within the time shown. If it is not, you can try again.
  5. Orders are prepared only after payment is confirmed.

7. Invoice

  1. We issue invoices through tax-authority-certified invoicing software and send them by email.
  2. If you want your tax number (NIF) on the invoice, enter it at checkout. Without a NIF, the invoice is issued to a final consumer. By law, an invoice cannot be changed afterwards to add a NIF.

8. Delivery

  1. We deliver to addresses in mainland Portugal by courier, usually within 1 to 3 working days after payment is confirmed. Collection at the farm is also possible by appointment. [VERIFY: actual courier and delivery times]
  2. In any case, delivery takes place within 30 days of the contract being formed. If we cannot meet this, the customer may cancel the contract and will be refunded immediately.
  3. The risk of loss or damage passes to the customer only when they, or a third party they indicate other than the carrier, physically receive the goods.
  4. On delivery, please check the packaging and contact us as soon as possible if any product arrives damaged, ideally with photos. This does not affect your statutory rights.

9. Right of withdrawal (returns without reason)

  1. If you are a consumer, you have the right to withdraw from the contract within 14 days without giving any reason, under articles 10 to 17 of Decree-Law 24/2014. The period starts on the day you, or a third party you indicate other than the carrier, physically receive the goods. For an order with several items delivered separately, it starts when the last item is received.

  2. How to withdraw: send us a clear statement (for example, by email to geral@exemplo.pt) or use the withdrawal form. It is enough to send it before the period ends.

  3. Returning the goods: return the goods without undue delay and at the latest 14 days after telling us of your decision. The direct cost of returning the goods is borne by the customer. [VERIFY: whether the shop wants to cover it]

  4. Refund: we refund all payments received, including standard delivery costs, within 14 days of being informed of your decision. We use the same payment method as the purchase unless agreed otherwise, at no cost to you. We may withhold the refund until we receive the goods or you provide proof of having sent them, whichever is first. If you chose a delivery method more expensive than standard, the difference is not refunded.

  5. The customer is liable for any loss in value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

  6. Exceptions: under article 17(1) of Decree-Law 24/2014, the right of withdrawal does not apply to:

    • sealed goods which are not suitable for return for health protection or hygiene reasons and were unsealed after delivery (for example, a bottle of olive oil, a jar of honey or a bag of almonds with a broken seal);
    • goods which are liable to deteriorate or expire rapidly.

Our products can be returned within the period if they are unopened with the seal intact.

10. Legal guarantee of conformity

  1. Products are covered by the legal guarantee of conformity under Decree-Law 84/2021. We are liable for any lack of conformity existing at delivery that becomes apparent within three years, bearing in mind the perishable nature of food: products must conform until the best-before date on the packaging, provided they were stored as indicated.
  2. In case of non-conformity, the customer may ask for a replacement, a price reduction or termination of the contract, as provided by law. Contact us at geral@exemplo.pt.

11. Liability

We are not liable for delays or failures caused by force majeure. Nothing in these Terms limits the rights consumers have by law.

12. Complaints and dispute resolution

  1. You can make a complaint by email to geral@exemplo.pt or through the Electronic Complaints Book (Livro de Reclamações Eletrónico). We answer complaints made there within 15 working days.
  2. In case of a dispute, consumers may use an Alternative Dispute Resolution (ADR) entity under Law 144/2015: CNIACC – Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (https://www.cniacc.pt). We have not adhered to any ADR entity, but consumers may use it as provided by law. The full list of ADR entities is available on the Consumer Portal (www.consumidor.gov.pt).

13. Governing law and language

  1. These Terms and Conditions are governed by Portuguese law. This choice does not deprive consumers of the protection of the mandatory rules of their country of habitual residence.
  2. The contract is concluded in Portuguese. The Portuguese version prevails over this translation.

14. Changes

We may change these Terms and Conditions. Each order is governed by the version in force and accepted when it was placed.
